Winter Has Come – Our Winter Rights and Duties

Everyone annually longs to see streets full of snow, children sledging, wonderful landscapes and all these advantages of winter. But winter, what is worth to know especially to landlords, is bounded with some duties too. I would like to present some behavior that our legislator requires from us.

Lets start with the most obvious things, like clearing entries to the shops or interior roads. It is not necessary to be genius to say that to owner of these things is obliged to get rid of snow and make it easier to safely go through.

Similarly things are regulated in car park matters. We have right to demand clear and safe parking places of head administrator of these parking, particulary when administrator is commune or country. They are liable for making street drivable and, I repeat because it is very material thing, safe. It is the biggest duty connected with winter – provide safety.

Objects of duties are slightly different when it comes to pavements. Every owner of the immobility has a duty to take care for area which is directly next to his property. Owner or administrator is fully obliged to make pavements clean with exception of situation when it is allowed to park on the pavement with a charge. In this situation object taking profits has a duty to take care about the tidiness.

When we get hurt and this hurt would be caused by act or omission of object mentioned earlier, we can demand remedies on the ground of civil code – art 444. When the harm is serious, we are limited in moving, our chance for a great future has decreased or we can properly do our work we can even demand a pension.

But here appears a big problem. There is a huge figure of people unconscious of all these obligations and connected with these liabilities. Accident happens and people do not use they rights or they do not fill theirs obligations. Wouldn’t it be better when the state would be responsible for all these duties and in the same time for omissions? What do you think?

    I still hope that law will be changed, i fully approve of making state responsible for all this duties in particular of taking care of pavements, especially if someone insist on walking by at 6 o’clock.
    Of course it would also help those injured party by this terrible negligence because there is sometimes problem to force other party to pay up pension.
    And i believe that our Country do it so much better.
